By accessing and using this website (“cvc.world”), operated by City vs City Volleyball Association LLC (“City vs City,” “we,” “us,” or “our”), you agree to comply with the following legally binding Terms and Conditions (“Terms”). Unauthorized use may result in legal action including claims for damages or criminal prosecution.

2. Intellectual Property

All content on this website, including without limitation text, images, logos, graphics, and design elements, constitutes the intellectual property of City vs City and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, distribute, or otherwise use any materials without our express prior written consent.

3. Third-Party Links

This website may contain hyperlinks to external websites operated by third parties. City vs City makes no representations concerning the accuracy, legality, or appropriateness of any third-party content. Use of such links is undertaken at your own risk.

4. Limitation of Liability

City vs City shall not be liable for any direct, indirect, incidental, consequential, or special damages of any kind arising from or in connection with your access or use of this website.

5. Disclaimer

6. User Contributions

H-Town Serve Challenge – Official Contest Rules

Eligibility

Participation is open to individuals aged 10 years or older. Individuals who are current or former professional, semi-professional, Olympic, collegiate, or junior collegiate volleyball or beach volleyball players or coaches, and who have competed or coached at that level within the past six (6) years, are not eligible. Employees and immediate family members of City vs City Volleyball Association, LLC, its sponsors, vendors, and affiliated entities are also ineligible.

Contest Format & Requirements

Each selected contestant will attempt to serve one volleyball over the net into a designated target area. The ball must land and remain entirely within the target without rebounding or contacting any other object, person, or surface. The serve must be a traditional volleyball serve—holding the ball in one hand and striking it with the other (no throws or pushes). Foot faults or stepping on or over the service line will disqualify the attempt. No practice serves will be permitted after being identified as a finalist.

Prize Information

Twenty finalists will be eligible to win up to $10,000, contingent upon a successful serve as defined above. All prizes are subject to verification. Winners must submit a completed W-9 form and any additional documentation required. Contestant selection is non-transferable and must be claimed in person.

Video Verification

All attempts will be documented through continuous, unedited video recordings to verify legitimacy. The footage must clearly display the serve, including the ball remaining in the target area.

How to Enter

Follow @cvc4v4 on Instagram. Post volleyball-related content such as serves, spikes, trick shots, or highlight moments. Tag @cvc4v4 and use the hashtag #HTownServeChallenge in every post. Each post equals one entry. Unlimited entries are allowed. Forty winners will receive two complimentary tickets to the tournament and may be chosen to compete for a $10,000 prize on center court.

Discount Code Competition

Organizations are eligible to receive and share unique discount codes for tournament ticket purchases. The organization associated with the most redeemed code will receive 50 brand new Mikasa volleyballs. Each code provides a $5 ticket discount.

General Provisions

City vs City Volleyball Association reserves the right to disqualify any participant not in full compliance with these rules. Participation constitutes acceptance of all stated terms.

 

 

Universal Waiver and Release of Liability, Assumption of Risk, and Indemnification Agreement

(Applies to All Individuals Assisting with and/or Participating in Any Capacity at the H-Town Showdown Volleyball Tournament – May 30 to June 1, 2025, held at District 249 and the Humble Civic Center)

READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT

1. Assumption of Risk

Participant acknowledges the inherent risks associated with involvement in the Event, including serious injury, illness, disability, emotional trauma, death, and damage to property. These risks may arise from physical exertion, environmental conditions, equipment, or actions of others. The Participant assumes all such risks, whether caused by the negligence of the Released Parties or otherwise. The Participant further agrees to be solely responsible for any injury or loss sustained.

2. Release and Waiver of Liability

To the fullest extent permitted by law, Participant releases and discharges City vs City Volleyball Association, LLC, District 249, the Humble Civic Center, their respective officers, agents, and affiliates (collectively, “Released Parties”) from any and all claims related to participation in the Event, including those arising from negligence, premises liability, or other causes of action.

3. Indemnification

Participant agrees to indemnify and hold harmless the Released Parties from all claims, losses, liabilities, and expenses (including attorney’s fees) arising from their conduct, actions, or omissions related to the Event.

4. Medical Authorization

Participant confirms they are physically capable of safely participating and authorizes emergency medical care if deemed necessary. Participant assumes all related medical costs.

5. Jury Trial and Class Action Waivers

Participant waives the right to a trial by jury and to participate in any class action or representative proceeding against the Released Parties.

6. Governing Law and Venue

This Agreement is governed by Texas law. Venue for disputes shall be exclusively in Harris County, Texas.

7. Media Release

Participant consents to the use of their name, likeness, and image for promotional purposes by the Released Parties, without compensation.

8. Entire Agreement and Acknowledgment

This document represents the full agreement between the Participant and the Released Parties. By checking the ‘I Agree’ box, the Participant affirms they have read, understand, and consent to all terms.

By using this website, participating in any City vs City Volleyball Association, LLC event, or assisting in any capacity at our tournaments, you agree to be legally bound by the following Terms and Conditions. These provisions include liability waivers, contest rules, and indemnification agreements crafted with reference to prevailing Texas law and industry best practices.

READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT

This Waiver and Release of Liability, Assumption of Risk, and Indemnification Agreement (the “Agreement”) is executed by the undersigned individual (the “Participant”) in favor of and for the benefit of City vs City Volleyball Association, LLC, District 249, the Humble Civic Center, and their respective owners, officers, directors, managers, employees, contractors, affiliates, sponsors, agents, and assigns (collectively, the “Released Parties”).

1. Assumption of Risk

Participant understands and acknowledges that participation in or assistance with any activities related to the Event involves inherent risks, both known and unknown, which may result in serious personal injury, illness, permanent disability, emotional distress, death, or property damage. These risks may result from physical activity, environmental exposure, surface or weather conditions, equipment use, crowd-related hazards, or acts or omissions of third parties or the Released Parties. Participant voluntarily assumes all such risks, regardless of whether caused in whole or in part by the negligence, gross negligence, or strict liability of any of the Released Parties.

2. Release and Waiver of Liability

To the maximum extent permitted under Texas law, Participant hereby waives, releases, discharges, and covenants not to sue the Released Parties from any and all liability, claims, demands, causes of action, losses, or damages arising out of or relating to participation in or assistance with the Event. This waiver includes, without limitation, claims for personal injury, illness, wrongful death, property loss, and attorneys’ fees, whether arising in tort, contract, or any legal theory, even if caused by the sole, joint, or concurrent negligence or fault of any of the Released Parties.

3. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, causes of action, demands, losses, liabilities, judgments, and expenses (including attorneys’ fees and court costs) arising out of or related to Participant’s actions, omissions, or conduct in connection with the Event.

4. Medical Authorization

Participant certifies that they are in good physical condition and have no known medical conditions that would prevent safe participation. Participant authorizes Event organizers and emergency personnel to secure medical care and treatment if deemed necessary. All associated costs shall be the sole responsibility of the Participant.

5. Jury Trial and Class Action Waivers

Participant knowingly and voluntarily waives the right to a trial by jury and agrees not to initiate or participate in any class action, representative action, or collective proceeding related to the Event or this Agreement.

6. Governing Law and Venue

This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Venue for any dispute shall lie exclusively in a court of competent jurisdiction located in Harris County, Texas. Participant irrevocably consents to such jurisdiction and waives any objections to venue or forum non conveniens.

7. Media Release

Participant consents to the capture and use of their name, voice, likeness, and image by the Released Parties for marketing, promotional, and documentation purposes, in any medium now known or later developed, without further approval or compensation.

8. Entire Agreement and Acknowledgment

This Agreement constitutes the full and complete understanding between the Participant and the Released Parties regarding liability and participation in the Event. By checking the box marked ‘I Agree,’ the Participant affirms that they are at least 18 years of age (or have obtained parental/guardian consent if under 18), have read and understood this Agreement, and voluntarily accept its terms. This digital acceptance shall have the same legal force and effect as a signed written agreement.
